By accessing or using FixRoast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our Service. These Terms constitute a legally binding agreement between you and FixRoast.

We reserve the right to modify these Terms at any time. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

2. Description of Service

FixRoast is a Software-as-a-Service (SaaS) platform that provides AI-powered landing page analysis and optimization recommendations. Our Service includes:

• Automated analysis of publicly accessible web pages
• AI-generated feedback on design, copy, user experience, and conversion optimization
• PageSpeed Insights integration for performance metrics
• Core Web Vitals analysis
• Actionable recommendations and fixes
• Screenshot capture and comparison

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not share your account with others or create multiple accounts

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Submit URLs that you do not have permission to analyze
• Analyze websites containing illegal, harmful, or malicious content
• Use the Service for any illegal or unauthorized purpose
• Attempt to circumvent usage limits, rate limits, or access restrictions
• Interfere with or disrupt the Service, servers, or networks
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to harm, harass, defame, or infringe on others' rights
• Resell or redistribute the Service without authorization
• Use automated tools (bots, scrapers) to access the Service

5. Subscription Plans and Pricing

5.1 Free Tier

Our free tier includes 2 roasts per month with basic features. Free accounts are subject to usage limits and may not include all premium features.

5.2 Starter Plan

The Starter plan costs $12/month (or $120/year billed annually, equivalent to $10/month) and includes 15 roasts per month with additional features like AI Fix Prompt, PDF export, and email support.

5.3 Pro Plan

The Pro plan costs $39/month (or $390/year billed annually, equivalent to $32.50/month) and includes 50 roasts per month with all premium features including AI Fix Prompt, PDF downloads, and priority support.

5.4 Payment Terms

• All prices are in US Dollars (USD)
• Payments are processed securely through DodoPayments
• Subscriptions auto-renew unless cancelled before the renewal date
• Price changes will be communicated with 30 days notice

6. Shipping & Delivery

Digital Product Notice: FixRoast is a digital service. There are no physical products to ship.

• Delivery Method: All services are delivered electronically through our web platform
• Access Time: Upon successful payment, you will have immediate access to your subscription features
• Roast Reports: Analysis reports are generated instantly (typically within 60-90 seconds) and are accessible from your dashboard
• PDF Exports: Available for immediate download (Starter and Pro plans)
• No Physical Delivery: As a SaaS product, there is no physical shipping involved

7. Refund Policy

Due to the digital nature of our service:

• Subscriptions: No refunds for partial months or unused time. You can cancel anytime and continue using the service until the end of your billing period.
• Annual Plans: No prorated refunds for early cancellation of annual subscriptions.
• Technical Issues: If you experience technical issues preventing service access, contact us within 7 days for a resolution or credit.
• Exceptions: Refund requests may be considered on a case-by-case basis for billing errors or duplicate charges.

8. Intellectual Property

Our Property: The Service, including its design, features, code, AI models, and content, is owned by FixRoast and protected by intellectual property laws.

Your Content: You retain ownership of URLs you submit and your data. By using the Service, you grant us a limited license to analyze and process your submitted content to provide the Service.

Roast Reports: The analysis and recommendations generated by our AI are provided for your use. You may use and share your roast reports as you see fit.

9. AI-Generated Content

Our analysis and recommendations are generated using artificial intelligence (Google Gemini).

• AI outputs are suggestions and should be evaluated critically
• We do not guarantee accuracy, completeness, or suitability of recommendations
• You are solely responsible for implementing any changes to your website
• We are not liable for any outcomes resulting from implementing AI suggestions

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results
• Uninterrupted or error-free operation

WE DO NOT GUARANTEE THAT THE SERVICE WILL IMPROVE YOUR CONVERSION RATES, TRAFFIC, OR BUSINESS RESULTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FIXROAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES

12. Indemnification

You agree to indemnify and hold harmless FixRoast, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• URLs you submit for analysis

13. Termination

By You: You may cancel your subscription at any time through your account settings or by contacting us.

By Us: We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment
• Abuse of the Service or other users

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

Before initiating any legal proceedings, you agree to contact us to attempt to resolve the dispute informally within 30 days.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and FixRoast
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms; we may assign them freely
